These Terms of Service ("Terms") govern your use of the Voxeia AI voice calling platform and related services ("Services"). By accessing or using our Services, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization.
2. Description of Services
Voxeia provides an AI-powered voice calling platform that enables businesses to automate outbound and inbound phone calls using artificial intelligence. Our Services include:
- AI voice agent creation and management
- Automated call scheduling and execution
- Call recording, transcription, and analytics
- CRM and third-party integrations
- API access for custom implementations
3. Account Registration
- You must provide accurate, complete registration information
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to create an account
- One person or entity may not maintain more than one account
- You are responsible for all activity that occurs under your account
4. Acceptable Use
You agree NOT to use our Services to:
- Make calls that violate TCPA, GDPR, or any applicable telecommunications regulations
- Engage in harassment, fraud, or deceptive practices
- Send spam, robocalls, or unsolicited commercial calls without proper consent
- Impersonate any person or entity or misrepresent your affiliation
- Attempt to reverse engineer, decompile, or access the source code of our platform
- Interfere with or disrupt the integrity or performance of our Services
- Use the platform for any illegal purpose
5. Billing & Payment
- Services are billed on a pay-as-you-go basis unless otherwise agreed in writing
- Prices are subject to change with 30 days' notice
- You are responsible for all charges incurred under your account
- Failed payments may result in service suspension
- Refunds are issued at our sole discretion, typically within 30 days of a valid request
6. Intellectual Property
All content, technology, and intellectual property in the Voxeia platform remain our exclusive property. You retain ownership of your data, scripts, and content uploaded to the platform. You grant us a limited license to use your content solely to provide the Services.
7. Service Level & Availability
We strive for 99.9% uptime for our platform. Enterprise customers may negotiate specific SLA terms. We are not liable for service interruptions due to factors beyond our reasonable control, including third-party provider outages, natural disasters, or government actions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXEIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless Voxeia, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
10. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will make your data available for export for 30 days following termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use after changes constitutes acceptance of the modified Terms.
